My name is Chris Hyland, I’m an attorney with Hyland, Padilla & Fowler, PLLC and a question a lot of clients have is.. I want to sue my employer, or, they may be concerned that we may be suing their employer. It really depends on the circumstance. In most cases in North Carolina, an injured worker files a worker’s compensation claim against the insurance company. They are not permitted to file any claims against the employer, unless the employer did something that put them at a very high-risk of having a substantial injury.
We’ve seen those cases before and we can certainly let you know if that’s a possibility. But, in almost every case, the claim goes against the insurance company, and the insurance company is responsible for paying the doctor bills and the time out of work. We do not sue the employer, that is not where the claim begins, we would only pursue the employer if the facts and the law require it for your particular case.
