I’m Chris Hyland with Hyland, Padilla & Fowler, PLLC attorneys. One of the questions that we get about hiring an attorney is: “Do I have to pay the attorney, or what’s it going to cost me to hire an attorney?” Most personal injury in North Carolina works on a contingency fee. What that means is the attorney gets a percentage of whatever your case settles for. In some cases, for whatever reason, if there are things that are discovered later, or a person decides not to go forward with their case, an insurance company may not agree to pay anything on the case. In any circumstance, if the insurance company pays absolutely no money, and there are zero recoveries, then the attorney’s fee would be zero. There may be some costs and expenses that are incurred, but they’re usually very minimal. If the case goes forward, then some law firms like Hyland, Padilla & Fowler, PLLC will change the attorney’s fee. In some smaller cases, we reduce the fee, but the standard percentage for most personal injury cases can be 33%. Some firms will charge more if it’s a medical malpractice case, and some firms will charge more if your case goes to trial. We will not increase the fee if your case goes to trial.
